1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Subscriber", "you", "your") and Shovel Radar ("we", "us", "our"), a commercial intelligence service operated from Calgary, Alberta, Canada. By purchasing a subscription, accessing our reports, or using our website at shovelradar.com, you agree to be bound by these Terms in full.
If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity.
2. Description of Service
Shovel Radar provides weekly commercial permit intelligence Reports ("Reports") derived from publicly available municipal, provincial, and federal Canadian open-data sources across 382 Canadian cities and every province plus 2 territories. Anchor coverage is Calgary, Alberta; full source list per city is published in the READ ME tab of each delivered workbook and at shovelradar.com/cities/.
Reports are delivered to Subscribers via email (and/or per-customer Google Drive folder once a Subscriber exceeds 20MB / month delivery volume) in Excel (.xlsx) and CSV format, and may include lead lists, permit summaries, decision-maker contact information, and sales guidance materials. The content, format, set of cities covered, and delivery schedule of Reports may be updated from time to time at our discretion.
3. Subscriptions and Payment
Subscriptions are billed on a recurring monthly basis in Canadian dollars (CAD) via Stripe, Inc. By providing your payment information, you authorize us to charge your payment method on a recurring basis until you cancel.
- Billing occurs on the same calendar date each month from the date of first payment.
- Subscription fees are exclusive of applicable taxes (including GST/HST/QST). Applicable taxes will be added to your invoice once our GST registration is complete.
- We reserve the right to change subscription pricing upon 30 days' written notice to your registered email address. Price changes take effect at the next billing cycle following the notice period. Founding-member rates communicated in writing at time of sign-up are locked for 24 months from the sign-up date.
- Failed payments will be retried up to three times over seven days. Failure to collect payment after retries may result in suspension or cancellation of your subscription.
3.1. Multi-City Add-Ons and Discount Stack
Subscribers may add coverage for additional Canadian cities to an active subscription at 50% off the standalone price of each additional city, stackable across any number of cities. The discount is applied to the lower-priced city when two cities of different price tiers are bundled. The Subscriber's primary city is the first city subscribed (or, where ambiguous, the most expensive city in the bundle). Federal procurement layers (CanadaBuys, MERX, federal contract awards) are bundled with every subscription at no additional cost; they are not a chargeable add-on.
If a Subscriber cancels the primary city while retaining one or more add-on cities, the next-most-expensive city becomes the new primary at its full standalone price; remaining add-ons continue at the 50%-off rate. Cancellation of any individual city takes effect at the end of the current billing period for that city.
3.2. Launch Promotion — 14-Day Free Trial (First 5 Customers)
Subject to availability, the first five (5) net-new paying Subscribers globally (regardless of which Canadian city or product they select) are eligible for a 14-day free trial with no credit card required. The promotion applies to any combination of cities or products. To redeem, contact us at matthew@shovelradar.com referencing the launch promo. Once the 5 seats are claimed, the promotion is closed; standard 14-day post-payment refund terms (Section 5) apply to all subsequent Subscribers.
At the end of the 14-day trial, Subscribers may elect to start a paid subscription at the published rate, the city add-on rate (Section 3.1), or to walk away with no charge. No automatic conversion to paid will occur without explicit Subscriber consent.
4. Cancellation Policy
You may cancel your subscription at any time by emailing matthew@shovelradar.com. Cancellation takes effect at the end of your current billing period. You will continue to receive Reports until that date. We do not offer pro-rated refunds for partial billing periods. After cancellation you will not be charged further.
5. Refund Policy
14-day full-refund window on the first paid month. If you email matthew@shovelradar.com requesting cancellation within fourteen (14) calendar days of the date of your first paid charge, we will refund the entire first-month payment in full, no questions asked. By that point you will typically have received two (2) weekly Reports — sufficient to evaluate volume, accuracy, and trade-fit.
After day 14, all subscription payments are non-refundable. Because Reports contain time-sensitive commercial intelligence and the value is captured by the Subscriber upon receipt, refunds cannot be issued for any billing period beginning after the 14-day window has lapsed, nor for any subsequent month.
Annual prepayments are subject to the same 14-day refund window from the date of the first annual charge; after day 14, annual prepayments are non-refundable. If you cancel an annual plan after day 14, your subscription will continue through the end of the prepaid period; no pro-rated refund will be issued.
The 14-day refund window applies only to the first paid month per business entity per product. Refund requests on subsequent billing cycles, on resubscription after a prior cancellation, or on any second product purchased by the same entity are not eligible for the 14-day refund.
If you believe a billing error has occurred, contact us within 7 days of the charge and we will review it in good faith.
6. Subscription Models and Territory Exclusivity
We offer four ways to purchase: single-product subscriptions, vertical bundles (4-9 products grouped by buyer persona), single-month one-time purchases (no auto-renewal), and enterprise quotes (custom pricing for 50+ FTE / multi-office / API access). Most products are non-exclusive — multiple Subscribers in the same trade category may purchase the same Report. We may impose a soft cap of 10 simultaneous subscribers per product per city and re-price or split into per-quadrant exclusivity if cannibalization between subscribers is observed.
Per-quadrant exclusivity (Calgary only) is available for products where territory matters (industrial-warehouse, site-services, bin-rental, future roofing / snow / paving). One quadrant ≈ 50% of the city-wide price; cap of 4 buyers per product (1 per NW / NE / SW / SE quadrant). Exclusivity is granted on a first-paid, first-served basis and maintained only for as long as the subscription remains active and in good standing. Per-region or per-borough exclusivity in other Canadian cities (e.g., Toronto wards, Montréal arrondissements, Vancouver neighbourhoods) may be offered on request where the city's open-data geography supports it; pricing and caps will be quoted at time of inquiry. Exclusivity does not constitute any broader commercial exclusivity, partnership, or agency relationship.
Premium niche products may have hard subscriber caps disclosed at the time of purchase (e.g., REIT alerts: 8 max; New Developer Quarterly Brief: 5 max; Whale Lists: 3 per vertical, per city). Sold-out scarcity is a feature of these products.
6.1. First-Delivery Policy and Date Floor
To ensure subscriptions reflect ongoing value rather than a one-time historical dump, every Subscriber's first Report contains rows whose source date falls within the 30 days immediately preceding the subscription start date. Reports thereafter are delivered weekly and include only rows new since the prior delivery. A Subscriber who maintains continuous subscription for 12 months will, by that point, have received the full historical depth of the underlying datasets — but a one-month subscriber will not.
If you cancel and resubscribe within 12 months of your prior cancellation, your subscription is treated as a continuation: you will receive only rows new since your last delivery, not a fresh 30-day historical window. After a 12-month gap, resubscription is treated as a new subscription.
6.2. Plan Changes and Product Switching
Single-product Subscribers may change which Report they receive subject to a 90-day cooldown between changes. This prevents subscription cycling that would accumulate the historical content of multiple products at the price of one. Upgrades from a single product to a vertical bundle (or from any subscription to a higher-priced one) are available at any time and take effect at the next billing cycle. Downgrades take effect at the next billing cycle and do not entitle the Subscriber to a refund of the difference in fees previously paid.
6.3. Account Integrity and Sample Policy
Each business entity is entitled to one (1) free 30-day data sample. Submitting the sample-request form using multiple email addresses, business names, or payment methods controlled by the same individual or entity is a breach of these Terms and may result in immediate ban from the service.
Subscribers must register accounts using accurate identifying information (legal entity name, business address, payment method belonging to the entity). Creating multiple accounts to bypass the first-delivery date floor (Section 6.1), the plan-switching cooldown (Section 6.2), the resubscription continuity rule (Section 6.1), or any other provision of these Terms is grounds for immediate cancellation without refund and forfeit of any outstanding sample.
We reserve the right to fingerprint accounts using a combination of payment method (Stripe customer ID), legal entity name, and business address to detect duplicate accounts. Identified duplicates will be merged or banned at our discretion.
7. Licence and Permitted Use
Upon payment of the applicable subscription fee, we grant you a limited, non-exclusive, non-transferable licence to use the Reports delivered to you for your own internal business development purposes. You may not:
- Resell, sublicense, redistribute, or share Reports with any third party (except via the Team-Seat feature below, which extends access to authorized teammates within your own organization).
- Use Reports to build a competing product or service.
- Remove or obscure any branding, watermarks, or attribution from Report files.
- Use contact information in Reports for mass automated outreach in violation of Canada's Anti-Spam Legislation (CASL).
All intellectual property in the Reports, including selection, arrangement, and presentation of data, remains the property of Shovel Radar.
7.1. Team Seats — Acceptable Use
Your subscription includes a per-tier seat allowance (currently: 1 additional seat on Solo/Single, 3 on Bundle/Specialty, 10 on Enterprise/Territory). Each seat may be a portal sign-in for a person within your own organization.
You may not: (a) share seats with anyone outside your organization, (b) sell or transfer seat access, (c) use a shared mailbox (e.g. info@) as a seat to circumvent the per-seat limit, or (d) automate seat-creation to bypass the limit. We reserve the right to revoke seats found in violation and, on repeat violation, to suspend the underlying subscription without refund.

7.2. Saved Searches & Pinned Permits — Acceptable Use
The portal allows you to register up to 25 saved searches and up to 100 pinned permits per account. These features are for your own legitimate sales / business-development use. You may not:
- Use saved-search alerts to scrape our index for resale.
- Register searches designed to flood your email or another customer's inbox.
- Use pinned permits to construct a derivative dataset for redistribution.
7.3. AI-Generated Content Disclaimer
Some Reports may include an AI-generated call-script column produced offline using a third-party large language model. AI-generated text is provided as a suggestion only. It may be inaccurate, out-of-date, or unsuitable for your specific situation. You are responsible for verifying any AI-generated text before relying on it for outreach, business decisions, or anything binding. Shovel Radar disclaims liability for any AI-generated content — your use of it is at your own discretion.
8. Nature of Data — Public Sources
All permit and business data included in Reports is sourced from publicly available government datasets across Canada, including (non-exhaustive list):
- Municipal: City of Calgary, City of Toronto, City of Vancouver, City of Edmonton, City of Ottawa, Ville de Montréal, City of Mississauga, City of Brampton, City of Halifax, City of Winnipeg, plus 100 additional Canadian cities, each via their respective Open Data Portals.
- Provincial: Alberta Health Services (AHS), Alberta Gaming Liquor & Cannabis (AGLC), Alberta Energy Regulator (AER), Ontario provincial portals (Open Data Ontario, MERX, ACT), Données Québec (incl. Régie des alcools, des courses et des jeux), British Columbia Data Catalogue, Manitoba Geoportal, Atlantic-province open data (NS, NB, PE, NL).
- Federal: Government of Canada open data (open.canada.ca), CanadaBuys, MERX, federal contract awards, Statistics Canada (StatCan), CMHC, CRA T3010 charity disclosures.
- Enrichment: Google Places API, Google Gemini API, DuckDuckGo public web search — used solely to enrich publicly listed business contact information.
We aggregate, filter, and format this data but do not independently verify its accuracy, completeness, or currency. Permit and licence records may contain errors, delays, or omissions that originate with the source dataset. Contact information where included is derived from public business registries, Google Places, or other open sources and may be outdated.
Reports are provided as commercial intelligence to inform your business development activities. They are not legal advice, financial advice, or a guarantee of any business outcome.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SHOVEL RADAR'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE — WHETHER IN CONTRACT, TORT, STATUTE, OR OTHERWISE — SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE CALENDAR MONTH IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
We are not liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to lost profits, lost business opportunities, wasted bid costs, or reputational harm, even if we have been advised of the possibility of such damages.
In particular, we are not liable for:
- Inaccurate, incomplete, or stale data in public source datasets (municipal, provincial, or federal).
- Incorrect or disconnected phone numbers or email addresses in Reports.
- Permit records that are delayed, cancelled, or modified after Report delivery.
- Any business decision made in reliance on information contained in a Report.
- Service interruptions caused by third-party providers (Vercel, Google, Stripe, or any municipal / provincial / federal open-data API).
- Source-dataset takedowns, schema changes, or licence-term updates that disrupt or delay a specific city's coverage. Where a city becomes unavailable, the corresponding add-on charge will be suspended.
10. Disclaimer of Warranties
THE SERVICE AND ALL REPORTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY PARTICULAR LEAD WILL RESULT IN A BUSINESS OUTCOME.
11. CASL Compliance
Contact information in Reports is provided to facilitate human-initiated outreach in compliance with Canada's Anti-Spam Legislation (CASL). You are solely responsible for ensuring that any commercial electronic messages you send using information from our Reports comply with CASL, including obtaining express or implied consent, providing identification, and including a functional unsubscribe mechanism. Shovel Radar does not send automated cold outreach on your behalf.
12. Confidentiality
Each Report is licensed to you individually and is marked confidential. You agree to treat Reports as confidential business information and not to disclose their contents to any third party other than employees or contractors of your organization who need access for legitimate business purposes. This obligation survives cancellation of your subscription.
13. Termination by Us
We reserve the right to suspend or terminate your subscription immediately, without refund, if you breach these Terms, misrepresent your trade category, or use the service in a manner that is unlawful or harmful to us or to other Subscribers. We will notify you of termination by email where practicable.
14. Modifications to Terms
We may update these Terms from time to time. Material changes will be communicated by email to active Subscribers at least 14 days before taking effect. Your continued use of the service after the effective date of a change constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you may cancel your subscription before the effective date.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Calgary, Alberta. Before initiating formal proceedings, both parties agree to attempt in good faith to resolve any dispute by direct negotiation for a period of 30 days.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Shovel Radar with respect to the service and supersede all prior negotiations, representations, or agreements, whether written or oral. No waiver of any provision of these Terms shall be effective unless in writing signed by an authorized representative of Shovel Radar.
